GENERAL TERMS AND CONDITIONS - CANDLESTORE.BE
Candlestore.be (hereinafter referred to as “the seller”) is part of Lavini Nails & Beauty, located at Moortelveld 31, 9473 Welle, Belgium and owned by Kimberly Lavin.

Article 1: Definitions
1.1 Seller: Candlestore.be, a part of Lavin Kimberly.
1.2 Buyer: The person or entity that places an order via the Candlestore.be webshop.
1.3 Parties: Seller and buyer together.
1.4 Agreement: The purchase agreement between seller and buyer regarding the purchase of products via the webshop.
Article 2: Applicability of the general terms and conditions
2.1 These general terms and conditions apply to all deliveries by Candlestore.be. By placing an order, the buyer agrees to these terms and conditions and acknowledges that he is responsible for the purchase.
2.2 Deviations from these conditions are only valid if expressly agreed in writing between the parties.
2.3 An online purchase is binding from the moment the buyer has confirmed his payment in the payment environment of the webshop.
2.4 By placing an order, the buyer declares that he/she agrees to the terms of delivery and payment.
Article 3: Offers/Agreements
3.1 All offers from Candlestore.be are without obligation. Candlestore.be reserves the right to change prices, in particular when this is necessary based on legal regulations.
3.2 An agreement is only concluded after acceptance of the order by Candlestore.be. If an order is not accepted, the buyer will be informed of this within two (2) working days after receipt of the order.
3.3 Acceptance of an offer implies that the buyer accepts the applicability of these conditions.
3.4 Offers such as 'Fragrance of the Month', outlet and discounted items are not valid in combination with other promotions.
3.5 Offers and prices are valid on the day of publication on the website and for the period stated.
3.6 For promotions, the buyer must state the discount code in order to claim the relevant discount.
Article 4: Products, prices and payment terms
4.1 All products offered by Candlestore.be are described as completely as possible and to the best of our knowledge.
4.2 Images, specifications and data in offers are indicative. Colour deviations may occur due to the settings of the screens of buyers, for which Candlestore.be is not liable.
4.3 Candlestore.be is not liable for damage resulting from the use of products purchased via the webshop.
4.4 The prices stated are in Euro, including VAT, but excluding shipping and handling costs, unless otherwise stated.
4.5 All prices are subject to typing errors or other errors. Candlestore.be is not liable for the consequences of such errors.
4.6 Payment must be made immediately via the webshop.
4.7 Payment can be made via the following payment methods: Bancontact, iDEAL, Mastercard, Visa, Maestro, Belfius, KBC, CBC. In the physical showroom, payments can be made with Bancontact or cash.
Article 5: Delivery
5.1 The seller aims to ship orders within two (2) working days after receipt of payment, except in cases of force majeure. The delivery times stated are indicative. Exceeding the delivery time does not entitle to compensation or cancellation of the order.
5.2 Delivery will take place at the address specified by the buyer.
5.3 If the buyer has not provided the necessary information for the execution of the agreement, the delivery time will only commence after this information has been handed over to the seller.
5.4 In case of return of goods due to incorrect address information by the buyer, the buyer will pay the shipping and administration costs (€3.50) for a second offer via a payment link.
5.5 If delivery is not possible at the specified address, the order will be delivered to the nearest post office. A message will be left to inform the buyer. The buyer has 14 days to collect the order or arrange a new delivery. If the buyer does not act within the specified period, the order will automatically be returned to the seller. The buyer can have the order sent again against payment of additional shipping costs and an administrative fee of €3.50.
5.6 If the buyer does not wish to receive the order again, the amount of the order minus shipping and administration costs will be refunded.
5.7 The buyer must inspect the products upon delivery and inform Candlestore.be immediately (within two (2) working days) if the products do not comply with the agreement.
5.8 Candlestore.be is not liable for delays caused by the courier service.
5.9 Broken or damaged items must be reported to Candlestore.be immediately by email, accompanied by a photo of the damaged product. The amount of the damaged product will be refunded within 10 days.
Article 6: Retention of title
6.1 Ownership of the delivered products will only be transferred to the buyer when all payment obligations under the agreement have been met. However, the risk will be transferred to the buyer at the time of delivery of the products.
Article 7: Cancellations
7.1 After delivery, the buyer can no longer cancel the order, but he can exercise his right of withdrawal (see Article 8).
Article 8: Right of withdrawal
8.1 The buyer has the right to revoke the agreement within 15 days after delivery of the products, without giving reasons and without penalty. The buyer must inform Candlestore.be of this by e-mail.
8.2 The return shipment must be sent to the address of Candlestore.be, Moortelveld 31, BE-9473 Welle. The costs of return shipment are for the account of the buyer. The buyer must keep the proof of shipment.
8.3 If the right of withdrawal is exercised, the seller will, after checking the returned products, refund the purchase price within 30 days, with the exception of delivery costs.
8.4 The refund will be made via the same payment method as the original payment, or via bank transfer to the buyer's specified account number.
8.5 The right of withdrawal does not apply to used, damaged or incomplete products. The return shipment must be in unchanged condition and with the original packaging and accompanying documents.
8.6 Discounted items and gift cards cannot be returned.
Article 9: Privacy
9.1 The data that the buyer provides to the seller will only be used for administrative purposes in connection with the agreement. The data will not be provided to third parties, except if required by law.
Article 10: Force Majeure
10.1 In case of force majeure Candlestore.be is not obliged to fulfill its obligations. The obligations can be suspended or the agreement can be dissolved.
10.2 Force majeure means: circumstances beyond the will and control of Candlestore.be, such as strikes, fire, network disruptions or other unforeseen circumstances that hinder the execution of the agreement.
Article 11: Applicable law and competent court
11.1 All agreements between the parties are exclusively governed by Belgian law.
11.2 Disputes arising from or related to the agreement will be submitted to the competent court in the district of Aalst, Belgium.
